Peace and genocide in times of international delegation: The Palestinian drama

Abstract

This article aims to analyze the violent deconstruction of the Palestinian people from historical, legal, and peace-studies perspectives. The first subsection examines the creation of a humanitarian catastrophe through seven historical steps. Subsequently, the legal status of Palestine and the question of possible rights to legitimate resistance or self-defense of the actors involved are discussed. Third, the article explores the legal and political controversy surrounding the characterization of genocide in Gaza since 2023. Fourth, cognitive warfare and its global reach are examined. The fifth section analyzes the growing hostility toward the international legal order and the actors interested in processes of de-juridification. Finally, the article evaluates the so-called Trumpist peace project of October 2025 and contrasts it with possible paths toward a durable and sustainable peace in the southern Levant.

Author Biography

Bernd Marquardt

Professor of public law, constitutional theory, state theory, and legal history at the Faculty of Law, Political Science, and Social Sciences of the National University of Colombia, Bogotá. Founder and director of the CC – Comparative Constitutionalism research group (Minciencias category A1 since 2013) and senior researcher at the same institution. Doctor of Law with summa cum laude (1999) and second higher doctorate – Central European Habilitation (2003) – from the University of Sankt Gallen (Switzerland). He completed a postdoctoral degree in Law at the National University of Colombia (2018). He has taught and researched at universities such as St. Gallen, Zurich, Göttingen, Linz, and the Autonomous University of Saltillo, among others. He has more than 250 publications.
