The irregular and, in certain cases, improper conduct of public officials in digital environments, as well as the administration’s response to such situations, have gained increasing relevance in academic, administrative, and jurisprudential spheres. This phenomenon is due to the proliferation of social media use in daily life in recent years, which has sparked a debate regarding its regulatory implications and the scope of its governance.
While in Germany, the discussion has been becoming relevant in relation to administrative aspects, in Colombia, the situation has been addressed from the perspective of fundamental rights, specifically from the right to freedom of expression.
